Man - Another day, another reason to be cynical about the world.

Gee, only fourth place, guess I need to work a little bit harder!

Don't let creeps like this spoil our hobby by everyone starting to put watermarks on their photos, or worse yet, stop posting. The web, just like the rest of life, has it's share of sicko's and creeps. Ignore them.

For those who have had photos stolen I would recommend contacting Flickr's copyright infringement department (Yahoo Inc.) at copyright@yahoo-inc.com detailing what is happening.

I emailed Yahoo yesterday when Walter pointed this out to us however I was told the actual owner of the photos would need to contact them in order to have the issue resolved. I will include their reply and case number below.

Re: Stolen photos (KMM93616892V34885L0KM)

Thank you for contacting Yahoo! Inc. ("Yahoo!"). Yahoo! respects the
intellectual property rights of others and we ask that our users do the
same. Yahoo! has established a policy for receiving and processing
notifications of infringement in accordance with the Digital Millennium
Copyright Act ("DMCA"), other applicable laws and/or Yahoo! policies.

Your recent correspondence was insufficient to constitute an effective
Notification of Infringement ("NOI") within the meaning of the DMCA
and/or as required by Yahoo! policy. The elements required for an
effective NOI, and the contact information for submitting a NOI to
Yahoo!, are included below and at http://info.yahoo.com/copyright/details.html.

If you are the copyright owner or are authorized to act on behalf of the
copyright owner and you would like to submit a NOI in response to this
email, please include the following:

1. A description of the copyrighted work or other intellectual property
that you claim has been infringed;

2. A description of the location where the material that you claim is
infringing is located;

3. A statement by you that you have a *good faith belief* that the
reported use is not authorized by the copyright or intellectual property
owner, its agent, or the law;

4. A statement by you, *made under penalty of perjury,* that the above
information is accurate and that you are the copyright or intellectual
property owner or authorized to act on the copyright or intellectual
property owner's behalf; and

5. Your address, telephone number, and email address;

6. Your electronic or physical signature. If the submission is made
electronically, please designate your electronic signature by typing a
forward slash ("/") before and after your name and follow this
electronic signature by again typing your name. For example:

/Jane Doe/
Jane Doe

Please note that attachments cannot be accepted due to security
concerns.

Once Yahoo! has received a NOI containing each of the required elements
detailed above, Yahoo! will process your request.

We wish to thank you in advance for your anticipated cooperation in this
matter. Please contact us if you have any questions or we can further
assist you in this matter.

Regards,

Copyright/IP Agent, Yahoo! Inc.

Hey guys, guess what?

I thought this dude sounded familiar. Back on 9 January of this year, I got a RailPictures.net contact from him asking about how he might find his way onto a charter operated by the guy who is famous for doing Cass trips. I might actually get to meet the photo thief himself in few weeks.....

woody_k 03-03-2009 12:57 AM

He says he uses a Kodak easy share...doesn't the efix infor stay with the photo?

But wouldn't that mean he'd have to go through the effort of taking them in the first place?

Or your camera. It always starts with the pics...

JRMDC 03-03-2009 01:26 AM

I am stunned to see he has used one of mine; he has really bad taste. :)

I have a photo.net account and I will drop a complaint in there somewhere with a link to this thread.

EDIT: I decided that, as my shot was only used at shuttercal, I would put my complaint there, and so I have.

And here is the shot, might as well get a bit more glory out of it. :)

I received a e-mail from Ray.

I asked them to take my account down - most of the pics are mine. But the
temptation was there. I caved in to it. I am arrogant and disingenuous.

Darryl Rule 03-03-2009 01:48 AM

I got the same email back Walter.

I sent a note to the owner of this photo club with a link to this posting. If my local club had someone in it who was stealing photos, there would be quite the uproar. It's one thing to go after this guy himself, but folks associated with him on a photographic level need to know that he is not on the up and up.

What an odd person.
Chase

Too bad there was no conductor around. At least get the story right... My photos have been removed from the calendar thanks to an email I sent through the 'Legal Stuff' link. They also said they will keep an eye on him...whatever that means.

Now, if that's not really him, then that means he stole that picture as well and is claiming to be the person in the shot. That would be really, really sick.

well i guess he is sick cause its not him. look at the myspace profile and his profile pic. not the same person, unless he plays the part of the brawny man on weekends.

KevinM 03-03-2009 02:25 AM

I sent the Yahoo people an e-mail as per Chris's instructions. I guess we'll see how seriously they take copyright issues there.

Walter S 03-03-2009 02:44 AM

It looks as if he or Yahoo took all the RP pics on Flickr except yours Kevin. Weird

Yeah, I think it would take a lot of effort on his part to steal the pictures in the first place. One was posted on 3 galleries and even his myspace.

He better hope he's MR. Brawny guy in the picture then. I won't let go of my camera without a fight.

I got the same thing, I sent him an email even though he didn't steal any of my stuff; but I dislike thief's and liar's intensely.8)

Hmmm... Based on what I can see, his "flickr.com" page is gone too. Not sure if the Yahoo People took action or if he pulled the account down himself.

BTW, all of the pictures I've seen of the guy did look like the one of him standing on the pilot of the 15 at Steamtown. If he really wanted to look cool in that shot, he needed filthier gloves!

Walter S 03-03-2009 03:25 AM

If he wanted to look cool, he wouldnt have worn overalls into Steamtown to take his photo haha. I would expect this from a 5 year old not a full grown man.

Yeah Kevin after I posted that they were all taken off. We won!

So you can still wear overalls into Steamtown?
